I am guessing that the person who's eye socket was broken has made no formal complaint and is probably included in the catch-all offence of Affray too.
If all three were involved in the charged Affray then the Crown cannot use their testimony against each other, because they are all Co-Accused which basically means that unless there are independant witnesses The Crown are using the CCTV as evidence in chief which is very dangerous to say the least.

Plus the fact that the CCTV has already gone nationwide one would have to question whether a fair trial could be held?
The maximum punishment is 3 years in chokey, trust me NO ONE gets that for Affray. If proven, which again is optimistic, Stokes is facing a maximum of 12 weeks inside is my estimate. Based on the premise that he has no form so to speak, a period of Community Service and a fine and a curfew is more than the likely outcome if indeed the jury find them guilty and indeed if it ever gets that far.


So does this mean that Stokes' statement here is wrong?

if co-offenders are tried together the statement of one accused is only admissible against its maker and is not evidence against any other accused.

We need to know what relationship exists between the three co-accused here. Stokes has no lawful reason to say anything at all that may incriminate himself.

It's s shame ASC don't use our Crime systems any more, with the latest one, the CPS would be that fed up waiting for updates to come through on the Case, that they'd throw it out!

The 12 members plus the chairman of the ECB voted AGAINST the reintroduction of Stokes into the England squad, until the legal team advised them that Stokes could sue them, if his exclusion continued, so they counted again and he won.

It was a poor innings, true, the bowling was excellent but at 23-7 I went up to bed, angry and stunned by it all, that was all inside one hour.......the Kiwis did to us what we did to the Aussies at Trent Bridge a couple of years ago.

Its very difficult to lose a test match on day one, but fair play to England, we did our best.

The law's of the game pretty much say that's the maximum they can be punished. Silly that telling a batsmen to "fuck off" after bowling him can get you banned for longer than if you deliberately cheat by damaging the ball.

I fully expect Smith to permanently lose the Aussie captaincy though. So hopefully a lesson learnt.

I'm not sure they would do it close to an ashes series..
But to be fair to the Aussies they are disgusted at their actions.

For the number 1 and 5 batsman in the world to be involved, is bad

I wonder if anyone is pawing over the last ashes footage as we speak..?
